The Supreme Court has given a major decision to uphold the constitutional validity of the Aadhaar. Aadhaar is also not mandatory for UGC, NEET and CBSE examinations. This biometric data will not be shared with anyone without the permission of the court. At the same time, it is still mandatory to link the Aadhaar with PAN.

The Supreme Court said that the government will now have to ensure that illegal migrants do not get Aadhaar card. The court further said that the education had brought us from the thumb to the signature, but the technique has brought us back to thumb impressions from the signature.

The Supreme Court said that as far as possible the Central Government will make a strong law for data protection as soon as possible. The judgment was pronounced by the Bench of five judges. Among them judge AK Sikri, Chief Justice of India Deepak Mishra and Justice AM Khanwilkar was chiefly involved. The other two judges Justice DY Chandrapur and Ashok Bhushan wrote their separate opinions.

Justice AK Sikri wrote in his judgment, "It is better to be unique and the Aadhaar is unique." The petitioner's arguments were different, there are fundamental differences between the Aadhar card and identity. Once the biometric information is saved in the system, these stay saved."

Aadhaar is mandatory:

i. For application of PAN card

ii. To filing Income Tax Returns

iii. To get benefit of government's beneficial schemes and subsidies

Aadhaar is NOT mandatory:

i. For mobile SIM

ii. For opening a bank account

iii. For admission of a child to school

iv. For CBSE, NEET and UGC exams

v. If children, below 14 years of age, do not have the Aadhaar, they cannot be denied the services offered by the Central and State Governments.

vi. Telecom companies, e-commerce firms, private banks cannot ask for Aadhaar.
