The Ministry of Finance has proposed amendment of income tax rules for issuing "no/lower tax deduction certificate" online. Income Tax Rules, 1962 prescribe Form No. 13 for filing an application for seeking a certificate under section 197 and/or under section 206C (9) of the Income-tax Act, 1961, for no deduction of tax or deduction/collection of tax at lower rate. In fact, the Income Tax Department has proposed to make changes in Form-13 and Income-tax laws related to it. This will reduce the human interference in issuing certificates and compliance will be even easier.

The Department of Revenue has said that in order to implement the new system, it will have to make changes in Form-13 and its provisions. The department has sought suggestions from the general public on the proposal. Comments and suggestions on the draft notification may be sent by 4th September, 2018 electronically at the email address ts.mapwal@nic.in. According to the draft notification of the department, the certificates will be issued online after changes in the rules. There will be no human interference in this. Compliance will also be easy.

The senior citizens have to complete a lot of complex procedures in getting nil or lower tax deduction certificates from Income Tax Department. They have to submit copy of Form-13 in the respective income tax office. Except for some States like Karnataka and Goa, there is not a centralized procedure for taxpayers to apply online for this certificate in other states of the country. It is welcome to implement such a system in all states. The Department has made a draft notification of the proposal for change in Form-13 rules on its website www.incometaxindia.gov.in.
